§ 2-5. Elections procedures.

  • (a)

    Intent. It is the intention of the mayor and town council that all elections and the procedures governing registration, candidates, and elections shall be fair, and open to the public and do not discriminate on the basis of race, creed, sex, national origin, or disability.

    (b)

    Procedures for board of elections supervisors.

    (1)

    All official written communications to and from the board of elections shall be through the office of the town administrator, who shall also be authorized to accept service of process on behalf of the board. All official written communications, opinions of the board of elections, except for routine letters, shall be approved by the town administrator and the board of elections' attorney.

    (2)

    The meetings of the board of elections are public meetings except as provided by state law and the town clerk shall attend all meetings of the board and shall keep their minutes and records.

    (3)

    The board shall review its elections procedures and practices after each election.

    (4)

    The board shall exclusively follow the regulations and working procedures adopted pursuant to C-18 of the Charter.

    (5)

    When the town election regulations are silent on an issue, the board may review other sources such as state law or the rules and regulations of other Maryland municipalities for guidance and shall consult with the board's attorney on any such issue before taking any action, or rendering any opinion.

    (6)

    Any new or proposed procedure or practice regarding registration, certification or election or any amendment to existing procedures or practices shall be in writing and approved pursuant to this chapter and the Charter prior to the implementation of such procedure or practice by the board.
