§ 6-11. Municipal infractions and penalties.

  • (a)

    Violation of any provision of this chapter as to one (1) tree worthy of preservation shall be a municipal infraction subject to a penalty of five hundred dollars ($500.00). Violation of any part of this chapter as to more than one (1) tree worthy of preservation or a subsequent offense for violation of any provisions of this chapter shall be a misdemeanor punishable by a one thousand dollars ($1,000.00) fine and/or seven (7) days in jail.

    (b)

    Violation of any provision of this chapter as to a tree (other than a tree worthy of preservation) shall be a municipal infraction and subject to a penalty of fifty dollars ($50.00) for the first inch caliper of each tree (or the first five (5) feet in height of an evergreen), plus twenty-five dollars ($25.00) for each additional inch caliper of the tree (or each additional foot in height of an evergreen) up to the maximum allowed by law.

    (c)

    A violation of any other provision of this chapter (not already provided for) shall be a municipal infraction. The penalty for such violation shall be fifty dollars ($50.00). Every day that a violation continues to exist, shall be deemed a separate offense.

    (d)

    The town may also institute injunctive or any other appropriate action or proceedings at law or equity for enforcement of this chapter in any court of competent jurisdiction.
