§ 6-4. Jurisdiction and supervision.

  • (a)

    The town administrator or designee shall have jurisdiction and supervision over all trees, shrubs and grassy areas planted or growing in public places. The town administrator or designee shall have the authority and it shall be his or her duty to ensure that trees, shrubs and grassy areas in public places are planted, trimmed, sprayed, treated, preserved and removed as appropriate to ensure safety or preserve the symmetry and beauty of such public places.

    (b)

    The town administrator or designee shall be responsible for the town's beautification program. The town administrator shall encourage the efforts of the various town organizations interested in helping with the town's beautification program.

    (c)

    The town administrator or designee shall have the authority to supervise all work performed under any permit issued under this chapter.

    (d)

    It shall be unlawful for any person to hinder, prevent, delay or interfere with the town administrator or designee while engaged in the lawful execution or enforcement of this chapter. This shall not be construed as an attempt to prohibit the pursuit of any legal or equitable remedy in a court of competent jurisdiction for the protection of personal or property rights by any property owner within the town.

    (e)

    The town administrator or designee may prepare and submit an annual budget request to support the functions described above.
