§ 26-10. Construction and installation.

  • (a)

    Each franchise shall specify times for commencement and completion of construction of facilities and installations to subscribers.

    (b)

    Except for individual service drops, franchisees shall not run any line, make any attachment or commence any construction of any kind without the prior approval of the town, and the town shall have and maintain the right to inspect the construction and maintenance of all facilities of any franchisee which are located within the town. Maps of the location of all facilities within the town shall be maintained.

    (c)

    No poles shall be erected within the town by a franchisee for the purpose of installing its transmission lines, without the express permission of the town. Where existing utility poles are not available to the franchisee for this purpose, the franchisee's lines shall be installed below the surface of the ground to the extent practicable.

    (d)

    If a franchisee disturbs any pavement, sidewalk, shrubbery, ground cover, driveway or other surfacing, it shall at its own expense, and in a manner approved by the town, replace and restore such areas so disturbed in as good condition as before such disturbance commenced.

    (e)

    If, during the period of a franchise, the town or any other governmental agency or public utility desires to repair or relocate any of its facilities, and that repair or relocation requires the removal or relocation of the facilities of the franchisee, the franchisee shall promptly remove or relocate its facilities upon request of the town, with such costs to be assessed to either the franchisee or the concerned utility by either agreement or arbitration.

    (f)

    A franchisee shall not place any of its wires, structures or equipment where the same will interfere with any gas, electric, telephone, sewer or water line, fixture or equipment.

    (g)

    Each franchisee shall provide to all subscribers, at rates approved by the town, a converter, for use on existing TV receivers, which will provide reception of all channels provided by the franchise, and such other equipment as the franchisee may require to restrict or expand capability for selective purposes.
